Deforestation - what is it and what are the deforestation rules?

Deforestation is the transformation of forest land to the required form of land. Deforestation is carried out if it is necessary for:

  • Construction of buildings
  • Construction of other infrastructure objects - roads, trails, mineralized strips, drainage systems and forest fire fighting water intake points
  • Establishment of quarries and reservoirs
  • Restoration of protected biotopes

Deforestation rules

Deforestation rules stipulate that the initiator of deforestation submits a deforestation application to the forest district, in the supervision area of which the deforested forest land is located. The deforestation application must be accompanied by the following documents:

  • a document certifying ownership rights — a copy of the land register certificate;
  • if the documents are submitted by an authorized representative, then a certified copy of the power of attorney or authorization agreement;
  • a land boundary plan and a plan showing the boundary and area of the deforested forest land;
  • a forest land plan showing the area of the deforested forest land;
  • a topographic plan showing the instrumentally measured deforested area;
  • sketches or technical projects coordinated with the construction authority;
  • characteristics of the transformed plots of forest land;
  • environmental authority's technical regulations for the transformation of forest land or an environmental impact assessment opinion.

After the issuance of the forest land transformation permit, the forest district within 10 days sends copies of the forest transformation permit and all documents to the State Land Service, the municipality, the environmental authority and the nature authority.

The applicant for deforestation must inform the municipality and the forest district within 30 days of the completion of the works specified in the application. Never carry out forest land transformation without obtaining a permit, if the transformation is carried out without a permit, the State Forest Service will recover losses in triple amount! The transformation of forest land is considered complete when the State Land Service has made changes in the real estate cadastre information system.

What are the deforestation costs?

Forest land transformation is a time-consuming process where there are two main cost items - surveying and compensation for losses to the state for the damage caused as a result of deforestation. Surveying will cost on average about 250 euros per hectare for surveying, marking in nature and preparing sketches. Much larger costs are compensation for losses for the deforestation carried out, which can amount to tens of thousands per deforested hectare, where the forest district calculates the losses using the following formula:

Z = S x R tv x Dmin. x K1 x K2, where

Z — the damage caused (EUR)

S — the area of forest land to be transformed

R tv — the relative value of a hectare of forest depending on the type of forest growing conditions

Dmin. — the minimum monthly wage

K1 — the coefficient of restrictions on economic activity of forest land

K2 — the transformation purpose coefficient

The deforester must submit a payment order to the forest district within 10 days of receiving the loss calculation, which confirms that the loss compensation payment has been made.

How much does deforestation cost?
Each deforestation case is different, as the total deforestation costs are affected by the area and location of the land to be transformed. The deforestation price includes two main cost items - surveying and the calculated compensation for damages incurred, most of which will be for compensation, which can be even tens of thousands per hectare. The good news is that the amount of compensation can be significantly reduced by using Timbro's other clients' afforested areas.
Can forest land transformation be carried out without obtaining a permit?
Deforestation or forest land transformation can only be carried out with a permit issued by the State Forest Service. If you carry out deforestation without a permit, the State Forest Service will recover damages in triple amount, and criminal proceedings may also be initiated!
